Terms of Service

Effective May 14, 2026

1. Acceptance

By creating an account, generating an app, or otherwise using the ForkD platform (the "Service"), you agree to these Terms of Service ("Terms"). The Service is operated by ForkD LLC ("ForkD," "we," "us"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account. By signing up you represent that you meet this minimum age and that the information you provide (including date of birth, name, and email) is accurate. We may suspend or delete accounts we believe belong to under-18 users.

3. Account Rules

You are responsible for the security of your credentials and all activity under your account. You may not share accounts, use another person's identity, or operate more than one account to evade enforcement actions or Guardian risk scoring.

4. AI-Generated Code — No Warranty

The Service generates source code, configuration files, and related artifacts using large language models (currently Claude via OpenRouter) and AI orchestration pipelines. AI-generated output is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, including fitness for a particular purpose, non-infringement, security, accuracy, or App Store/Play Store compliance.

You are solely responsible for reviewing, testing, modifying, and securing any generated code before publishing it or shipping it to end users, and for complying with the App Store Review Guidelines, Google Play Developer Program Policies, and applicable laws in every jurisdiction where you distribute the resulting app.

5. Prohibited Use

See our Acceptable Use Policy for the full list. In short: no illegal content, malware, CSAM, harassment, IP infringement, fraud, or attempts to evade Guardian risk scoring.

6. Payment and Auto-Renewal

Paid subscriptions are billed through Stripe and renew automatically at the end of each billing period unless cancelled. See the Subscription & Refund Policy for billing cycles, cancellation, and refunds.

7. Suspension and Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms, the Acceptable Use Policy, or applicable law, or if your Guardian risk score crosses our enforcement threshold. You may stop using the Service at any time by deleting your account or contacting us at support@forkdme.com.

8. Intellectual Property

The ForkD platform, including the website, builder UI, planner pipeline, brand marks ("ForkD," "Build once. Earn forever.," the forked-Y logo), and underlying software, is owned by ForkD LLC and protected by copyright, trademark, and other laws. Code generated for you via the Service is licensed to you under the Generated-Code & On-Chain License Terms.

9. Limitation of Liability

To the maximum extent permitted by law, ForkD LLC's total aggregate liability arising out of or related to the Service is limited to the greater of (a) the fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). In no event will we be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, or lost data.

10. Indemnity

Each party will defend and indemnify the other against third-party claims arising from (i) its material breach of these Terms or (ii) infringement of third-party intellectual property rights, except to the extent the claim arises from the indemnitee's gross negligence or willful misconduct. Indemnity obligations are capped at the same amount as Section 9.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Mississippi, USA, without regard to its conflict-of-laws rules. The parties agree to resolve disputes first through informal good-faith discussions for at least thirty (30) days. If unresolved, the exclusive venue for any action is the state or federal courts located in Mississippi, and each party consents to personal jurisdiction there.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced at least thirty (30) days before they take effect, by email or in-product notice. Continued use of the Service after the effective date constitutes acceptance.

13. Service providers

To deliver the Service, ForkD relies on the following third-party processors. Your use of the Service constitutes acceptance of data being shared with them as needed: MongoDB (database), OpenRouter (Claude) (AI code generation), Expo / EAS (cloud builds + store submission), Expo Snack (in-browser preview), Cloudinary (image uploads), Stripe (payments), Twilio (SMS verification), Privy (server-wallet signing), Resend (transactional email), Solana devnet & the Guardian Anchor program (on-chain licensing), web-push providers (Apple/Google/Mozilla, for push notifications), and the ForkD marketplace backend at forkdme.com.
